Electricity Grid

The calculation of prices for the use of infrastructures has, over the years, developed into a core expertise of our infrastructure law team. We advise on the grid fee approval proceedings before the relevant authorities but also in many court proceedings which concern the fairness of grid fees (electricity and gas) and station use fees (railways) – including with existing fee approval by the relevant authority.

Generation: Renewable Energies

We bring comprehensive experience in complicated public law proceedings to the erection, operation and closure of decentralised energy generation facilities.

Gas

We act extensively in regulatory advice on reasonable pricing of gas grids (e.g., REGENT/AMELIE). That also includes questions of control and balancing energy. Currently, however, the security of the gas supply according to the SOS Regulation and the Energy Security Act take priority both for protected and unprotected customers.

Charging Station Infrastructure

We act throughout the process of selecting locations, discussions with owners (license agreements) and draft contracts with the Charge Point Operator (CPO), the E-Mobility Provider (EMP) and the electricity suppliers. We would be glad to draft general conditions of business for your charging infrastructure (LIS).

Biomethane

We advise important market players in the biogas market especially on all questions of contract drafting and price adjustments. That also includes the trading in greenhouse gases reduction quotas (RED II, the Federal Emissions Act (BImschG))

Contracting

Companies in the industry instruct us because of our result-oriented support in outsourcing and contracting models. We identify where the financial advantage for electrical energy produced in the client’s own power stations can apply and advise on questions of the transfer of undertaking. We tailor drafts for the contracting project even including the client’s own power stations and the sale of media (steam, electricity).

Price Adjustments/Profitability Clauses

Arbitration and court proceedings, including before the European Court of Justice, concerning the setting of reasonable prices are among our core capacities. Price abuse proceedings before the anti-trust courts, proceedings under § 315 Civil Code before civil courts or the making of price adjustment claims based on profitability or the destruction of the basis of the transaction, often play an important part in our practice.
