Local Public Passenger Transport (ÖPNV)

Our law practice on questions of public passenger transport enjoys an excellent reputation on the market. In particular, we have advised for many years on the financing of local passenger public transport services by service agreements under Regulation (EC) No. 1370/2007 and general regulations. Emphasis thereby is on direct procurement in which we provide support both in advance by the creation of the conditions for direct procurement and in the conduct of the actual tendering.  We advise municipal transport companies, their contractors and/or contractor organisations as “responsible authorities” and medium-sized transport companies nationwide. We see ourselves thereby as “sector advisors“ monitoring the advances arising from the Clean Vehicles Directive and/or the Clean Vehicles Procurement Act and issues such as vehicle financing. We also keep the interests of applicants in concession competition in view.

We are ideally positioned not only in procurement law, but also in subvention law, corporate law and anti-trust law. In subvention law, we cover the wide-ranging demands (e.g., on vehicles) against breaches of the prohibition on subvention (Art. 107 (1) TFEU) and reimbursement claims. In other legal areas, we can, therefore, offer excellent solutions for very wide-ranging and very specific issues, for example in the areas of financing (deficit balancing), purchasing cooperation, or long-term urban transport planning.
