OPPENLÄNDER advises the President of the Thüringer State Parliament

Lawyer Prof Dr Christofer Lenz has advised the President of the Thüringer State Parliament on a motion by the AfD seeking the dismissal of the President of the Thüringer Constitutional Court and another constitutional judge.

On the basis of the expert opinion by OPPENLÄNDER Rechtsanwälte, the President of the State Parliament of Thüringen, Thadäus König, refused to submit a motion to dismiss the President of the Thüringer Constitutional Court and another constitutional judge. In doing so, he followed the result of the legal opinion by OPPENLÄNDER partner Prof Dr Christofer Lenz, which showed why the relevant requirements for dismissal under the Constitutional Court Act were not met.

Background: The senior president appointed by the AfD had blocked the election of a president in the constituted session of the state parliament. Only a decision by the Constitutional Court then enabled the majority of the state parliament to elect their candidate. The accusations levelled by the AfD against the judges involved that they had committed a gross breach of duty or were even guilty of obstruction of justice have no basis.

The President of the State Parliament of Thüringen had commissioned Prof Dr Lenz to prepare the expert opinion because he is co-editor of a renowned commentary on the Federal Constitutional Court Act and Chairman of the Constitutional Court Committee of the Federal Bar Association.
