OPPENLÄNDER successfully defends sausage manufacturer in fundamental dispute against the “Schutzverband Nürnberger Bratwürste”

The Schutzverband Nürnberger Bratwürste e.V. has taken legal action against the sausage manufacturer Franz Ostermeier GmbH before the Munich I Regional Court. In particular, it objected to the shape and size of the sausages produced in Lower Bavaria and the design of the packaging. According to the protective association, the manufacturer was infringing the protected geographical indication “Nürnberger Bratwürste / Nürnberger Rostbratwürste”.

The Munich Regional Court I dismissed the action yesterday. The size and shape of the sausages did not establish a link to the protected geographical origin.

Dr. Christina Koppe-Zagouras is a well-known competition lawyer and, according to Handelsblatt and Best Lawyers, one of the best lawyers in Germany.
