OPPENLÄNDER wins organ dispute for parliament

OPPENLÄNDER Rechtsanwälte, represented by Prof. Dr Christofer Lenz and Dr Henrike Schulte, has defended a CDU member of the Saarland state parliament against a petition for a dispute between organs. The Constitutional Court of the Saarland has determined that the President of the State Parliament, Heike Winzent (SPD), did not violate any constitutional rights when she authorized searches of the member of parliament suspected of a criminal offence. The Constitutional Court expressly stated this, although the applications were already inadmissible due to the time limit and lack of authority to apply – which it also stated. In doing so, it followed Prof. Lenz’s and Dr Schulte’s arguments across the board and also in the details of the reasoning.

Prof. Dr Christofer Lenz and Dr Henrike Schulte are a well-rehearsed team and regularly represent parliaments and other state bodies in constitutional court proceedings.
