What to do in case of an entry in the competition register?

The Bundeskartellamt’s new competition register is “armed”. The register, which is kept fully electronically, records companies which are to be excluded from public contracts on account of certain economic offences such as bribery, money laundering, tax evasion, violations of labor law provisions and cartel agreements and bid rigging. For companies participating in public tenders, a ban on awarding contracts can have existential significance. It remains to be seen to what extent private contracting authorities will also avoid companies entered in the competition register in the future. Our partner Dr. Matthias Ulshöfer discussed initial experiences and the question of how affected companies can be removed from the register as quickly as possible or not be entered in the first place with the Head of the Competition Register Department Kai Hoghoff, who traveled from Bonn especially for the event from the Federal Cartel Office, Bernd Peter, Dr. Ulrich Kinzl and Dr. Jürgen Bürkle in front of many interested listeners at the Stuttgarter Compliance Talks of the Stuttgarter Zeitung.
