Anti-trust Law and Competition Register

The new competition register of the Federal Anti-trust Office is live since 1st June 2022. Any entry in the competition register because of anti-trust offences, submission agreements or other procurement infringements can mean exclusion from public procurement opportunities. We advise our clients from the outset on how an entry in the competition register can be avoided and how an entry can be deleted by appropriate remedial measures. Anti-trust law also has a central role in the admissibility of bidder syndicates or double submissions by group companies or if public principals either alone or together occupy a dominating position on the procurement market.  In such cases, special requirements under the anti-trust law prohibition of discrimination apply in addition to the procurement law provisions. In transactions between companies active on the procurement market, we coordinate, to the best possible extent, the merger control provisions, anti-trust law and procurement law requirements.
