Torsten Gerhard studied law at the University of Mannheim. During and after his practical training periods in Speyer, Melbourne and Brussels, the Palatinate native worked as academic research assistant at the Chair for Criminal Law, Criminal Procedural Law, Commercial and Tax Criminal Law of Prof. Dr. Björn Burkhardt and subsequently at the Chair of Public Law of Prof. Dr. Wolf-Rüdiger Schenke at the University of Mannheim. Torsten Gerhard received his doctorate there with a thesis on administrative and constitutional procedural law.

Torsten Gerhard has been a lawyer at OPPENLÄNDER for over 15 years, in particular in the areas of public law and data protection law, since 2011 as specialised lawyer for administrative law. Since 2015, he lectures at the German University for Administrative Sciences in Speyer and in the law training course at the lawyers’ chamber Stuttgart. Since 2022, Torsten Gerhard also lectures at the Duale Hochschule Baden-Württemberg (University of Applied Sciences) Heilbronn on the law of wine and food. He is a member of the Working Group Administrative Law (Baden-Württemberg Group) in the German Bar Association (DAV) and of the German-Nordic Lawyers’ Association.

Expertise

Public law and data protection law are both central working areas of Torsten Gerhard.

In public law, Torsten Gerhard advises companies and the public sector on core questions, in particular construction and planning law, but also public law special areas, for example freedom of information law, gambling law or the Infection Protection Act. He brings his experience from earlier work as local councillor to his advice on municipal and local authority constitutional law issues.

Torsten Gerhard has special experience in conducting administrative and constitutional law proceedings. He appears regularly before the Federal Administrative Court and represents his clients also before the constitutional courts of the Federation and the Länder and before the European Court of Justice.

In 2010 – long before the General Data Protection Regulation (GDPR) came into effect – Torsten Gerhard established the data protection law practice at OPPENLÄNDER. Since then he advises clients on data protection law issues, in particular in the typical OPPENLÄNDER industries of health and mobility.

Torsten Gerhard is the author of many publications and regularly lectures at events and conferences. He is a co-author of commentaries and handbooks, including on hospital law, European election law and wine law.

Constitutional complaints of betting brokers successfully rejected: separation requirement under Gambling Law compatible with the State Constitution. In the constitutional complaint proceedings for the State of Baden-Württemberg, OPPENLÄNDER has in each case commented on the compatibility of the separation requirement with the requirements of the Basic Law and the State Constitution.
