Matthias Ulshöfer advises his clients for more than twenty years on all questions of antitrust law and procurement law. After studying at the Universities of Stuttgart (physics) and Tübingen (law) he obtained his doctorate with a theses on merger control in German, European and US-American law under Prof. Dr. Wernhard Möschel. He is a member of the Study Group Antitrust Law and was for a number of years officer for the Stuttgart region. He is specialist lawyer for procurement law, member of the German Institution for Arbitration (DIS), permanent contributor to the periodical “Vergaberecht” (procurement law), and regularly acts as examiner in second state examination (commercial law). He is author of many specialist publications and commentaries on anti-trust law and procurement law issues and speaks regularly at lecturing events.

Matthias Ulshöfer conducts proceedings for his clients in antitrust law and procurement law before all national courts up to the Federal Court of Justice (BGH), at the Federal Cartel Office, at the European Commission and before the European Court of Justice (ECJ). He is listed in the relevant handbooks for many years as “frequently recommended lawyer” in antitrust law and procurement law (JUVE) and as “leading advisor” (Who’s Who), “Top Lawyer” (Wirtschaftswoche) and “leading name” in procurement law (Legal 500).
In antitrust law he has achieved a number of fundamental judgements including on the admissibility of joint ventures and on restriction of competition and exclusive binding in distribution contracts. He represents his clients regularly in merger control proceedings and supports them in the conclusion of balanced commercial settlements on antitrust law compensation claims.
In procurement law he advises and represents nationally and internationally active bidders of all industries in procurement review proceedings before the procurement chambers of the Federal State and the Länder, often in technically complex procurement objects. He has made an impression on the development of health procurement law. He has achieved a number of leading judgements on the admissibility of discount invitations to tender and on open house agreements. He supports public principals in legally secure drafting of invitations to tender and in the defense of procurement law complaints. He is also active as arbitrator in proceedings under the DIS rules and in the increasingly significant antidumping and anti-subvention proceedings of the European Commission.
