Protection of trade secrets in civil proceedings
The GeschGehG has fundamentally reformed the protection of trade and business secrets. For the first time, German lawmakers have addressed the practical problem of protecting secrets in civil proceedings and regulated a differentiated system of mechanisms for protecting secrets from the public and the litigant in Sections 15 et seq. of the GeschGehG. GeschGehG, it regulates a differentiated system of secrecy protection mechanisms vis-à-vis the public and the litigant.
Together with Dr. Ben Steinbrück, our litigator Dr. Raphael Höll has provided a comprehensive commentary on the new provisions on the protection of secrets in civil proceedings. The commentary on the GeschGehG, edited by Dr. Jörg Brammsen and Simon Apel, is published in the series Wettbewerb in Recht und Praxis (wrp).
