Car Data

Modern vehicles produce large amounts of data that can be used and exploited for various purposes. This data not only includes information for repair and maintenance (RMI), but also information that is crucial for the further development of the vehicle and software, for autonomous driving and for data-based services for passengers. This raises a variety of legal issues that affect different areas of law. These include, for example, the contractual regulation of data access or the assertion or defense of access claims under antitrust law.

Special regulations for the maintenance and spare parts markets are contained in the sector-specific rules of the Approval and Market Surveillance Regulation (Regulation 2018/858). The General Data Protection Regulation (GDPR) sets out requirements in relation to personal data, while the Data Act (Regulation 2023/2854) regulates which data from connected products must be made available to whom.
