Anti-dumping and Anti-subvention Proceedings

The European Union has a broad range of measure as protection against dumping or subsidised imports including the imposition of long-term anti-dumping or balancing customs duties. Goods are deemed to be dumped if their price on export to the EU is lower than the price in normal market conditions of the exporting country. Goods are deemed to be subsidised if a non-EU government in the original or exporting country provides financial support or a form of income or price-support exists and thereby an advantage is given.  If an economic sector of the EU is thereby threatened, application for the commencement of proceedings by the European Commission can be made.  We support our clients in the institution of such proceedings and defend them if the impression is created that proceedings initiated by a competitor are in fact intended to distort competition and ultimately cannot be in the interests of the EU.
