On-Demand Transport and Alternative Forms of Transport

Both private and public transport “on demand“ is coming. The framework has already been created by the 2021 amendment to the Passenger Transport Act (Personenbeförderungsgesetz (PBefG)). It introduced new forms of transport with the integrated transport on demand (§ 50 PBefG) and the scheduled transport on demand (§ 44 PBefG). We advise in that area on the challenges posed such as the extension of licenses under the PBefG, financing (e.g., in the course of public service contracts) and the legal framework e.g., maintenance of standards for such transport forms. Digitalisation and associated issues such as control of motor vehicles by apps, e-ticketing and the central questions of data protection are also included in our practice spectrum. We assist companies in avoiding conflicts with the PBefG in the course of transporting their employees. We are also familiar with the legal questions arising from long-distance bus transport.
